This book offers the first comprehensive analysis of how human rights shape intellectual property (IP) law in Europe through the jurisprudence of the Court of Justice of the European Union and the European Court of Human Rights. Covering more than seventy years of case law, it examines how European courts balance IP protection with fundamental rights such as property, freedom of expression, privacy, business freedom, non-discrimination, and procedural guarantees including the right to a fair trial and good administration.<\/p>\n\n\n\n

Combining analytical chapters with carefully selected case commentaries \u2013  including decisions rarely discussed in the literature \u2013 the book provides a systematic guide to the growing constitutionalisation of intellectual property and the increasing role of fundamental rights reasoning in European IP adjudication. The launch will feature a presentation by the authors, followed by reflections from invited commentators and an open discussion with the audience.<\/p>\n\n\n\n
