However, the crucial importance of robust Text and Data Mining provisions in order to enable such strategy seems to have been overlooked. This was unfortunately already the case last year when the European Union adopted the <a href=\"https:\/\/eur-lex.europa.eu\/eli\/dir\/2019\/790\/oj\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\"Copyright in the Digital Single Market directive (opens in a new tab)\">Copyright in the Digital Single Market directive<\/a>, as its Article 3 and 4 are not living up to the challenge and the great ambitions now put forward by the Commission. <\/p>\n\n\n\n<p>This presentation will tell the history of the recent introduction of the text and data mining exceptions in EU\u2019s copyright law and show why the result was a missed opportunity to make Europe an attractive and vibrant environment for data-based innovations and more general for a true information society. Based on the findings of a comparative legal study done for the European Parliament during the elaboration phase of the directive and several recent papers (such as e.g. <a href=\"https:\/\/papers.ssrn.com\/sol3\/papers.cfm?abstract_id=3470653##\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\"Geiger\/Frosio\/Bulayenko, CEIPI research paper 2019-08 (opens in a new tab)\">Geiger\/Frosio\/Bulayenko, CEIPI research paper 2019-08<\/a>), the presentation will make proposals for the improvement of these provisions in order, to quote the recent EU strategic documents, \u201cto make Europe fit for the digital age\u201d. <\/p>\n\n\n\n<p><a href=\"http:\/\/www.ceipi.edu\/en\/ceipi\/the-ceipi-team\/christophe-geiger\/\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\"Christophe Geiger (opens in a new tab)\">Christophe Geiger<\/a> is Professor of Law and Director of the Research Department of the Centre for International Intellectual Property Studies (CEIPI) at the University of Strasbourg (France), which he leaded as Director General from 2008 to 2019 (11 years).
