Leveraging the EU Charter of fundamental rights in digital rights strategic litigation
on Friday 2 June 2023
This lecture will describe the Developing Information, Guidance, and Interconnectedness for (Charter) Rights Integration in Strategies for Enforcement (“digiRISE”) project developed by the Digital Freedom Fund (DFF). The Charter of Fundamental Rights of the European Union is an essential legal instrument in the protection of individuals’ rights within the digital sphere. The Charter’s host of rights and freedoms, designed to uphold EU values and the rule of law, are of growing importance in the upcoming “digital decade”. However, research has shown that the Charter is not used to its full potential to protect and promote (digital) rights and that awareness of the Charter and the means available for its enforcement is low amongst individuals and civil society organizations. There is a need for targeted and case-specific evidence, awareness raising and training on the Charter’s potential to protect digital rights and the means to enforce it, specifically, through strategic litigation. This lecture will first identify the EU Charter of fundamental rights’ potential in the defense and protection of digital rights. Then, it will explore the complex but interlinked network of national and EU regulatory bodies, judicial institutions and justice practitioners, Ombuds Institutions, NHRIs and CSOs capable of supporting or representing individuals or groups of claimants for the effective enforcement of the digital rights protected in the Charter. Finally, it will highlight the key role of collective action in enforcing the EU Charter in digital rights strategic litigation.
Dr. Alexandra Giannopoulou is a lawyer and a researcher with broad expertise in information law and the project manager of the digiRISE project at the Digital Freedom Fund. Her research addresses the regulatory challenges of emerging techno-social systems, with a strong digital rights focus.
She is a research fellow at the Institute for Information Law and an associate researcher at the CNRS Centre for Internet and Society (CIS) in Paris. Alexandra holds a PhD in intellectual property law from the University Paris II Pantheon Assas. She teaches Intellectual Property Law and Digital Arts at the Department of Digital Arts and Cinema, at the School of Economics and Political Sciences of the National and Kapodistrian University of Athens.
