Three strikes legislation in copyright law
A Critical Examination of Existing and Forthcoming Rules on 'Graduated Response' Copyright Enforcement Procedures Concerning Online Intermediaries

Looptijd: 2010
Auteurs:
P.B. Hugenholtz & B. van der Sloot

Samenvatting:
This research project examines and compares existing and emerging graduated response ('three strikes') legislation in France, the United Kingdom, Korea, New-Zealand, and various other countries. Graduated response laws typically require Internet access providers to terminate, or condition, subscriber accounts after a subscriber has been found to infringe copyright on multiple occasions. Three strikes legislation is being criticized for not duly respecting communication freedoms and other fundamental rights.
